Microgaming confirmed that your account was locked on evidence of using Artificial Intelligence software in your game play;
Clause 17 of the operator’s Terms and Conditions prohibits the use of any AI, behaving as described in Clause 18:
17. Bots/Artificial Intelligence
The below terms will apply whether any software or bot activity is or has been used in conjunction with the games client.
32Red Poker prohibit the use any use of bot software or artificial intelligence by players, whether commercially obtained or privately developed.
32Red Poker will actively monitor and look for such software on a player’s device, by registering the player consents to such software being searched for, and will not interfere with any of the detection mechanisms.
18. Prohibited Software
32Red Poker prohibit any software which:
• Provides any form of unfair advantage when a player uses it
• Shares hole cards among players, or facilitates collusion or cheating in anyway.
• Makes use of a database of hands and/or player profiles which is shared between users.
• Reduces or eliminates the need for a human to make decisive actions in play.
• Is designed to datamine (i.e. gather hands or player profiles from the game client beyond which the player has observed from their own play);
• Providing real-time advice or suggestive actions to take during play.
• Attempts to block any of our fraud or cheating detection mechanisms
32Red Poker will actively monitor and look for such software on a player’s device, by registering the player consents to such software being searched for, and will not interfere with any of the detection mechanisms.
Rule 1 contained in the Microgaming Poker Network Policy (MPN) (
https://mpn.poker/wp-content/uploads/2018/12/MPN-Game-Integrity-Policy-v2018-12.pdf) reiterates that the use of AI software is prohibited in game play:
1. Software is prohibited if it:
a. relies upon any form of artificial intelligence;
b. reduces or eliminates the need for a human to make decisions (for example, ‘bot software’ or tools that automatically fold specific starting hands);
c. shares hole (private or hidden) cards among players or assists collusion or cheating in any way;
d. utilises a database of hands or player profiles that is shared between users;
e. is designed to datamine (i.e. gather hands or player profiles from the game client beyond those which the player has observed from their own play) – see section ‘Datamining’ on page 5;
f. provides advice on the action to take during gameplay, including ‘Independent Chip Model’ (ICM) and ‘Game Theory Optimal’ (GTO) analysis tools;
g. is deemed by Microgaming to confer an unfair advantage on the player using it; or
h. attempts to block any of Microgaming’s fraud and cheating detection mechanisms.
Rule 5 states any AI software prohibited by Rule 1 is prohibited:
5. Software not covered by rule 1 is permitted. For example:
a. Tools intended solely for analysing a player’s own game, after gameplay has ended (‘Post Game Analysis Software’);
b. Tools intended for a player to be able to track their own playing habits or results (‘Tracking Software’);
c. Tools which overlay legitimately-gathered statistical information on the table (‘Heads Up Displays’ or ‘HUDs’).
Note: Even if software is Post Game Analysis Software, Tracking Software, or a Heads-Up Display, it is still prohibited if it contains any functionality that is prohibited under rule 1.
Clauses 26 and 27 of the operator’s Terms and Conditions state that an account may be locked and permanently closed and that funds may be withheld on any breach committed:
26. Locked/Closed Accounts
32Red Poker can, at their discretion, lock and/or permanently close a player’s account and without prior notice.
27. Player Funds
Should a player be found in violation of the poker rules or 32Red Poker’s Terms & Conditions, we reserve the right to seize all of the funds in the player’s account (and to reverse any pending withdrawals).
The evidence provided was reviewed and found to show patterns of behavior resembling AI use;
Due to the sensitive nature of the information provided, we are not at liberty to disclose such.
Given the above, we are satisfied that, upon evidence of being in breach of Clauses 17 and 18 of the operator’s Terms and Conditions, the operator acted in accordance with Clauses 26 and 27 by closing the account and retaining the funds.
In the absence of evidence to the contrary, the dispute will be closed in favour of the operator.
Kind regards,
Estelle
